California Policy to Protect the Elderly and Dependant Adult

The State Legislature of California recognizes the fact that it is possible for the elderly; disabled and dependant adults can be abused, neglected or abandoned. California recognized they have a responsibility to protect these citizens. The California State Legislature enacted the Elder Abuse & Dependant Adult Civil Protection Act to protect this defenseless class of California residents.

This legislation is specifically deliberately enacted to place attention on the needs and difficulties of the elderly and put into action laws to concentrate on the severe risk these defenseless California residents are at for abuse, neglect or abandonment.

The greatest people at jeopardy of being abused neglected and abandoned by their families or caregivers are the elderly and dependant adult, which suffer physical disabilities or compromised health places them in a defenseless position against these things.

Elements that often lead to abuse, neglect and abandonment of the elderly or dependant adult is due to economic instability, caregiver resentment of the responsibilities and stress, or drug or alcohol abuse by the caregiver.

The state of California will protect those elderly and dependant adults by fostering and promoting community services for their well-being, social and economical standard of living and protect those elder and dependent adults.

There are state guidelines in place to help protect the elderly or dependant adult by specifying when the protective service agencies will investigate allegations of abuse, the elderly and dependant adults. This also outlines the role of law enforcement when necessary to the elderly and dependant adults have the minimum level of protection in each county of California

The infirm elderly person or dependant adult are considered a disadvantage class, where cases of abuse or neglect in most cases are not prosecuted as criminal matters, and a limited amount of civil cases are brought. Reasons for this are due to difficulties with proof, court delays and the lack of incentives to prosecute the cases.
